In plain words
TapeHeart lets you make a mixtape with Apple Music and give it to one person. You need your own Apple Music subscription to build tapes and play songs in full. TapeHeart is free to download. If we add in-app purchases, the price is shown before you pay. You can stop using TapeHeart and delete your account at any time.
02Using TapeHeart
These terms are an agreement between you and Design For Hope LLC for the TapeHeart app and the website at tapeheart.app. By using either one, you agree to these terms and to the Privacy Policy.
TapeHeart is for making a tape for someone: choosing songs, putting them in order, writing a note, and sending a link. It is not a public music service, and it does not replace Apple Music.
TapeHeart is free to download. If we add in-app purchases, the price is shown before you pay. Apple Music is a separate subscription from Apple. TapeHeart does not charge you for Apple Music, and canceling TapeHeart does not cancel Apple Music.
03Accounts
You need an account to make and send tapes. Use an email address you can open, because we use it to confirm that a deletion request is really yours.
You are responsible for what happens through your account. There are no public profiles. A tape goes from you to the person you send it to.
The waitlist is separate. If you join it, we send one email when TapeHeart launches, then we delete that address unless you have an account.
04Apple Music
TapeHeart works with Apple Music only. You need an active Apple Music subscription to make tapes and to hear songs in full. Apple's own terms apply to Apple Music, and we don't control Apple's catalog, prices, or where a song is available.
Songs play in the order you chose. We don't store the audio. If a song isn't available where the listener lives, the tracklist and your notes still show, and that song is marked.
05Acceptable use
Use TapeHeart for personal mixtapes. Don't use it to break the law, to threaten or harass someone, or to send a tape the recipient has asked you not to send.
Don't try to break, scrape, or overload the service, and don't try to pull music out of Apple Music through TapeHeart. Notes and cards are yours to write, and they still have to follow the law.
We can refuse a tape, or close an account, that breaks these terms.
06Your content
You keep the words you write: the card, the liner notes, and who the tape is for. The songs stay with their rightsholders and play through Apple Music. You are not uploading audio to TapeHeart.
You give us permission to store the tape and deliver it to the person you send it to, so the gift works. That permission lasts until you delete the tape or the account, except for a tape you have already given. A tape you already gave stays with that person, as described in the Privacy Policy.
07Disclaimers
TapeHeart is provided as it is available. We work to keep it running, and we don't promise that it will be uninterrupted or that every song will play in every country.
We are not Apple, and we are not the people who own the songs. A note and a tracklist can still be read when a song can't play.
08Liability
To the extent the law allows, Design For Hope LLC is not responsible for indirect losses, such as lost profits, or for a song that Apple Music will not play. If we are responsible for a claim, the most we owe is the amount you paid us for TapeHeart in the twelve months before the claim. If you have not paid us, that amount is zero.
Some places do not allow these limits. Where that is true, the limits apply only as far as the law allows. Nothing in these terms limits liability for fraud, or for anything else the law says cannot be limited.
09Ending these terms
You can stop using TapeHeart at any time and delete your account in the app or from the account deletion page. We email you to confirm a request before we delete anything.
We can suspend or close an account that breaks these terms. If we discontinue TapeHeart, we will say so on the website. The sections on your content, disclaimers, and liability still apply after these terms end.
